Even the words used show how this addition ruined exactly what bitcoin was for - to allow witnesses to see all that happened (and yes, with a court order for private txns).
By segregating the witnesses from actions on chain takes away the power of public scrutiny. Criminals want to stay in the dark, make it difficult to find them, the opposite of all that gives bitcoin an edge.
Devs *must* have known they were opening a big backdoor for criminal activity with this change.
