Assuming ownership is established, it would be reasonable to expect property to be returned to use after a theft. In the case of a car, the manufacturer could produce a copy of the key (not relevant here) or rekey the car (send the UTXOs to a new address)
"Return to Use" as you say makes sense, as theft of key is theft of accessibility. Will be interesting to see how it plays out. Court cases don't always go as perfectly as hoped, or even as congruent with "law" as might be Rationally seen...
